I am beyond excited to meet you and your family and begin our creative journey together. Before we get started, there are a few things we need to address to ensure we are all doing our part to make this space safe, fun and productive. 

Before you read on, I would like you to consider the following: 

  • I run a very small business. This is not a large organisation. 
  • All sessions are art lessons - not babysitting or behaviour management classes. 

The decisions that are made throughout the terms and conditions are made with the two points above kept in mind. 

1. Introduction

These Terms and Conditions (“Terms”) govern participation in art lessons, workshops, and related services provided by Naomi's Little Studio (“the Studio”). By enrolling in a class, purchasing products, paying a quote or deposit for commissioned work, booking in for a workshop, or attending any Studio activity, you agree to abide by these Terms. 

2. Eligibility

Children’s Classes: Open to students aged 5–17. It is the responsibility of the parent/guardian to notify the studio if their child needs to move into a different class due to their age (i.e. birthday). 

While I understand there is a fee jump for the older classes, I ask that you notify me if your child should be moving up to a different class. I do my best to keep costs low for families to ensure that these lessons are affordable. Please respect this. 

Adult Classes: Open to participants aged 18 and above.

Mixed Workshops: Where children and adults attend together, parents/guardians remain responsible for supervising their child unless otherwise agreed upon. 

3. Enrolment and Payment

Classes: 

Payment is made in full at the time of the online booking by card. 

Refunds or credits will be offered in the event of class cancelled by the studio. 

In the event of a no-show, all paid funds will not be refunded. 

Products: 

Payment is made in full at the time of purchase at checkout by card. 

Refunds or credits are not offered for change of mind, purchase of an incorrect size or colour. In the event that products are faulty, a refund may be offered if proof can be shown. The customer must reach out to the studio to discuss problems. 

Commissioned artwork: 

If the customer agrees to the quoted payment, they will pay 50% of the quote by card before artwork begins. After the artwork has been completed, the remaining amount of the quote must be paid before the artwork is shipped. 

There are no refunds for commissioned work. In the event that an artwork is damaged in the duration of shipping and delivery, the customer must notify the Studio. Depending on the damage done to the artwork, a partial refund may be offered. 

4. Safety and Conduct

The Studio is committed to providing a safe, welcoming environment for everyone (including staff, students, adults and families). 

There is no tolerance for disrespectful or disruptive behaviour in these lessons. Please remember that your child's behaviour can impact on the experience of other children in the facility - positive or negative. It is imperative that parents understand that this is not a babysitting or behaviour management service. Hence, it is not the responsibility of the studio to correct or manage unreasonable behaviours. 

The Studio reserves the right to refuse entry or remove any participant engaging in disruptive, unsafe, or disrespectful behaviour. If requested by the Studio, parents/guardian must return immediately to remove their child from the premises. 

Children must be collected promptly at the end of each session. I suggest arriving 5 minutes early to ensure prompt collection time. 

Participants must follow all safety instructions regarding art materials and equipment. 

5. Materials and Artwork

All art materials are provided (unless specifically stated otherwise). 

Participants may bring personal materials at their own risk. I cannot guarantee the safety of your personal belongings, including art resources. 

However, participants are not to bring sharp, dangerous or illegal objects. They will be removed and/or the participant will be asked to leave immediately. 

Artwork created during lessons remains at the Studio until completion. This is to ensure that work is not lost between sessions. 

Student artwork may be included in images and videos taken for promotional purposes. 

6. Health and Wellbeing

Parents/guardians must inform the Studio of any allergies, medical conditions, or special requirements for child participants. This is to ensure that your child can be accommodated for as much as possible. However, we cannot guarantee that we can accomodate for every need, though we will do our best. 

Adults are responsible for managing their own health needs during sessions. 

The Studio is not liable for injuries sustained due to failure to follow safety instructions or any medical emergencies. 

The Studio is not liable for injuries sustained from commissioned work due to actions taken by the customer that are not reasonable and of intended use. 

Please be aware that as someone who works with children it is my responsibility to follow child safety policies and concerns. That means if I am made aware of any information that I believe puts a child at risk, I am legally required to report this concern to child protection professionals. 

7. Privacy and Photography

The Studio respects participant privacy. The participants agrees that all given details are current and correct. 

Photographs may be taken during classes for promotional use. Consent will be requested from adults and from parents/guardians of child participants during the first class with the studio. This consent will apply for every following session, unless the parent communicates a change in consent. 

For commissioned work, the customer will declare their preference of privacy in relation to the images provided to the Studio and the photography of the artwork. 

Please know that the studio is promoting with the purpose of growing a small business and expanding the customer base. Hence, we want our brand to be represented well. This will be reflected in the photographs that we choose to share via promotional methods. 

Promotional use includes, but is not limited to, social media, website, emails, newsletters, and more. 

Personal information collected during enrolment will only be used for class administration and communication.

8. Cancellations and Changes

The Studio reserves the right to cancel or reschedule classes due to unforeseen circumstances (e.g., illness, low enrolment, weather concerns or emergencies).

In such cases, participants will be offered a refund. All main contacts for each participant will be notified via text as soon as the cancellation is made. 

The Studio reserves the right to decline an enquiry for commissioned work if it is deemed offensive, harmful, inappropriate or unreasonable. 

Additionally, the Studio reserves the right to terminate an agreed commission work if given reasonable concerns. This may include (but is not limited to) unreasonable requests from a customer or an unforeseen situation that prevents the artist from completing the artwork (e.g. illness). The deposit may not be refunded, depending on the situation. 

9. Limitation of Liability

The Studio is not responsible for loss or damage to personal belongings.

Participation in classes is at the individual’s own risk.

To the maximum extent permitted by law, the Studio excludes liability for any indirect or consequential loss.

10. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the jurisdiction of the courts of Queensland.
